According to the Fair Labor Standards Act (FLSA), all non exempt employees who work over forty hours in a given workweek are entitled to overtime pay. UNPAID OVERTIME LAWSUITS
If you have been wrongfully denied overtime pay, you may be able to recover financial compensation through an overtime lawsuit. Workers who participate in overtime lawsuits may be eligible for a variety of damages including back pay, attorneys' fees and liquidated damages. In certain situations, punitive damages may also be awarded.
Under federal law, workers can recover unpaid overtime for work performed up to two years before the lawsuit is filed and until the case is concluded. If the employer's violation was willful, the worker may be able to recover up to three years of unpaid overtime. Additionally, workers who were wrongfully denied overtime may recover liquidated damages, which equal the amount of back pay awarded. For instance, if a worker recovers $3000 in unpaid overtime, he or she may be eligible for an additional $3000 in liquidated damages.
Workers who file overtime lawsuits may also be able to collect punitive damages if their employer retaliated against them for exercising their legal rights. For example, if an employer demotes an employee for filing an overtime claim, the worker may be eligible for punitive damages. Lastly, if the worker wins the lawsuit, the employer may be responsible for covering the employee's out-of-pocket litigation costs and an additional attorneys' fee.
