Best Buy assistant managers who were denied overtime pay after working more than 40 hours in a single workweek may be entitled to financial compensation. Allegedly, certain retail establishments have been classifying their employees as “assistant managers” in an attempt to avoid paying them overtime wages. According to overtime law, workers who manage a company and perform other managerial duties are not entitled to overtime pay. However, an employee who holds a managerial title, but spends most of their time stocking shelves, helping customers, operating the cashier, etc., is not performing managerial tasks and may still be entitled to overtime pay.

Overtime Exemptions for Assistant Managers

An assistant manager is only ineligible to collect overtime wages when they meet the following requirements: 

  • They are paid on a salary basis of at least $455 per week
  • They have the ability to hire and fire other employees
  • They direct the work of at least two full-time workers
  • They manage the company, a division or department 

If an employee does not meet each of these requirements, they are not exempt from overtime pay under the administration exemption, which is often held for managers, regardless of the job title they hold.

Assistant managers who were wrongfully classified as “exempt” employees, or those who do not qualify for overtime pay, may have legal recourse.
