Employees must be paid at least once a month. If a pay day falls on a weekend, holiday or other non-work day, the employee must be paid on the preceding workday. If an employee is absent on the payday, payment must be made on the next regular workday that the employee is present or by mail, if requested by the worker. Upon written request from the employee, wages may be deposited into a bank account. Wages may be paid in cash or by check, as long as the employer makes arrangements for these checks to be cashed. Workers who quit, step down, are suspended, fired or laid off, must be paid on the next payday.
In addition to pay requirements, Delaware wage and hour law requires employers to provide certain information upon hiring employees. Companies with four or more employees must inform their workers, at the time of hire, of the following:
- Pay Rate
- Day, hour and place of payment
- Fringe benefits and policies.
They must also give employees written notice of any decreases in pay and changes in the day, hour or place of payment, or benefits.
Employers with four or more workers must also provide pay-stubs clearly outlining the following:
- Wages due
- Pay period
- Deductions
- Total hours worked if the worker is paid on an hourly basis
