  • Florida employers must pay the higher minimum wage, whether state or Federal.
  • Because Florida does not have state laws regarding overtime, Florida employers must comply with Federal overtime law (Fair Labor Standards Act).
  • Employers must pay their workers the hourly state minimum wage for all hours worked. Companies employing "tipped employees" can count tips as wages. However, tipped workers must also receive a direct hourly wage of $4.23, effective July 24, 2009.
