Florida Overtime, Wage and Hour Questions

Back to Florida Overtime Law

What is overtime pay?

Overtime pay is time-and-a-half compensation paid to non-exempt employees who work more than 40 hours in one workweek.

Who can receive overtime pay?

Most Florida workers are entitled to overtime pay, even if they are told by their employer that they do not qualify. Certain job duties, however, may disqualify a worker from overtime pay, making them an exempt employee. To find out if you are eligible for overtime pay, contact a Florida overtime attorney.

Can tipped employees still receive overtime when working more than 40 hours in a week?

Yes. Waiters, waitresses, delivery people, servers and other tipped employees may still be able to receive overtime compensation when working more than 40 hours in one workweek.

Can salaried employees receive overtime pay?

Yes. Unless exempt, salaried employees are entitled to time-and-a-half pay for every hour worked in excess of 40 in a single workweek.

Should I receive pay for rest breaks?

If your break lasts less than twenty minutes, you should be compensated for this time.
