Restaurant Delivery Drivers Denied Overtime
Chinese food delivery workers, pizza delivery workers and other food delivery drivers who were denied overtime pay may be able to file an unpaid overtime claim for back wages.
According to overtime law, non-exempt employees are entitled to time-and-a-half compensation when working more than 40 hours a week. Unpaid Overtime Lawsuits: Food Delivery Drivers
In Dec. 2008, a judge ruled that more than 35 restaurant deliverymen were owed $4.6 million for their employer’s wage and hour violations. The judge ordered that the deliverymen, who worked at several Vietnamese restaurants throughout the city, were owed back pay and liquidated damages for violations of the Fair Labor Standards Act and state labor laws. In the unpaid overtime lawsuit, the judge decided that the Vietnamese restaurants made the following violations:
- Failing to comply with minimum wage and overtime pay requirements
- Failing to reimburse the food delivery drivers for motorcycle/bicycle purchases and repair
- Firing 22 deliverymen who attempted to enforce their employment rights
