What minimum wage and overtime provisions exist in Georgia?

Because there is no state-specific law regarding overtime and minimum wage in Georgia, state employees must follow regulations set by the federal law known as the Fair Labor Standards Act (FLSA).

What is overtime?

According to the FLSA, overtime is defined as hours actually worked over a certain "threshold", typically 40 hours per week. Certain government or medical jobs may have different thresholds.

Who can receive overtime pay?

Non-exempt employees in Georgia should receive time-and-a-half their regular rate for hours worked in excess of 40 in a single workweek.

What is considered work?

Work can be defined as job-related activities which benefit the employer; which the employer knows or should have known about; and which the employer does not prohibit from being performed. Work performed "off the clock" is considered work and should be compensated.
