Hourly employees at hospitals and other health care facilities are generally entitled to receive overtime pay when working more than 40 hours a week.

To be ineligible for overtime pay, a worker must meet a specific overtime exemption AND be paid a salary of at least $23,600 per year. Therefore, while there are a few exceptions, hourly employees, including those working at hospitals and other health care facilities, should receive 1.5 times their regular rate of pay when working more than 40 hours a week. If you are paid on an hourly basis and employed in the healthcare industry, complete our free case review form today. We will determine, at no cost to you, whether you can file an unpaid overtime lawsuit to recover up to three years of back pay.

Overtime Lawsuits: Hospital Employees

In May 2010, CareGroup Health System Inc. asked a judge to approve an $8.5 million settlement in a class action employment lawsuit accusing four of its hospitals and affiliates of violating the Fair Labor Standards Act, among other labor laws. If approved, the settlement will resolve all claims from hourly hospital employees who were employed by CareGroup or its affiliates from Sept. 3, 2006 through the date of the final settlement. According to the unpaid overtime lawsuit, CareGroup failed to pay hourly hospital employees for hours worked off the clock. A common overtime scam, working off the clock occurs when an employer requires their employees to perform work before or after their scheduled shifts. The overtime lawsuit also alleged that hourly workers were not compensated for interrupted or missed meal breaks.
