Idaho Overtime Law, Minimum Wage Questions

Back to Idaho Overtime Law

What is the minimum wage in Idaho?

Workers subject to the Idaho minimum wage law must be paid at least $7.25 per hour (effective July 24, 2007). On the same date, the federal minimum wage also increased to $7.25 per hour.

Who is considered a tipped employee? What is the Idaho minimum wage for tipped employees?

A tipped employee can be defined as a worker who customarily and regularly receives more than $30 in tips per month. When determining a tipped employee's wage, the worker's tips plus their cash wages must equal at least the Idaho minimum wage. In situations where the employee's tips and direct wages do not equal the Idaho minimum wage, the employer must make up the difference. Tips paid to an employee from a tip pool will not count as tips actually received by the worker. Therefore, only the tips actually retained by the employee can be counted toward the tip credit. Effective July 24, 2007, the tipped minimum wage in Idaho is $3.35.

Are there any exemptions to the Idaho minimum wage law?

Idaho's minimum wage law does not apply to the following employees:

  • Those employed in an executive, administrative or professional capacity
  • Outside salesman
  • Those engaged in domestic service
  • Seasonal employees of a nonprofit camping program
  • Workers under the age of 16 working part-time or at odd jobs not exceeding four hours per day with any one employer

Who can receive overtime?

Idaho overtime law states that non-exempt employees who work more than 40 hours in a single workweek should be paid at a rate of time-and-a-half their regular rate for overtime hours.

What is a workweek?

A workweek is a period of 168 hours during seven consecutive 24-hour periods. Typically established by the employer, a workweek can begin on any day of the week at any hour. When determining overtime pay, workweeks cannot be averaged.

What can I do if I am not receiving overtime pay or at least the Idaho minimum wage?

You can file a claim with the Idaho Department of Labor or contact an Idaho overtime attorney to find out if you can file a lawsuit to recover back pay.
