Rest Periods, Recordkeeping and Pay Days

Rest Periods: In addition to a lunch break, workers should receive a 10 minute rest period during each four hours worked. Short rest periods should be compensated.

Lunch Breaks: Employees should receive a reasonable lunch break, towards the middle of their shift. The timing of the lunch period can be negotiated through an agreement between the worker and employer.

Recordkeeping: Under the Kentucky Minimum Wage Law, employers must keep records for each employee containing the following:

  • Name
  • Address
  • Hours worked (per day and week)
  • Hourly pay rate
  • Overtime rate
  • Additions and deductions from the wages

These records should be kept for a minimum of one year. While no certain form or order is needed for these files, they must be easily accessed for purposes of inspection.

Pay Days: Employers must pay their workers all wages earned to a day no more than 18 days before the date of that payment. Workers who are not presented for the pay day, must be paid at any time upon six days' demand. Employees have the right to receive their full wages on each regularly scheduled pay day.

Final Wages: Workers who quit or are fired must receive their final wages by the next regularly scheduled pay day or 14 days after the date of separation, whichever occurs later.
