 If an employee in Louisiana leaves their company, they must be given their final pay check on the next regularly scheduled pay day within 15 days from the date of separation. This applies whether the work quit, was fired or laid off. The last paycheck should also include vacation pay.

Workers should send a written request for their final paycheck. After receiving the request, the employer must give the employee their final wages in a timely fashion. If the employee is not paid following the written request, the employer may be subject to a penalty. Because the Louisiana Workforce Commission does not enforce laws regarding final paychecks, employee must make a claim against their employer for their last paycheck through a private lawsuit.

According to Louisiana wage and hour law, an employer cannot penalize a worker or deduct money as a fine or penalty from the worker's paycheck, unless the worker damaged the employer's property. Deductions for property damage cannot exceed the amount of actual damage done.
