Maine Minimum Wage & Overtime Quick Facts
Maine Minimum Wage:
- The Maine minimum wage is $7.50 per hour.
- If the federal minimum wage exceeds the Maine minimum wage, the state minimum wage is increase to the same rate. The rate change would become effective on the day of the federal minimum wage increase.
Maine Overtime Law:
- Most employees should be paid 1.5 times their regular hourly rate for hours worked over 40 in a single workweek.
- When calculating the worker's regular hourly rate for purposes of overtime compensation, bonuses, commissions and other compensation that is based on actual work performed must be considered.
Maine Tipped Employee Laws
Employers can use tips to fulfill the minimum wage requirements for tipped workers, but the credit cannot exceed 50% of the minimum wage in Maine. Tipped employees have a right to keep their tips, but may volunteer to put their tips into a tip pool. Tipped employees are also entitled to tips placed on credit cards, which must be paid by their next pay day.
