Massachusetts wage and hour law defines a tipped employee as a worker who makes more than $20 a month in tips. The minimum wage in Massachusetts for tipped employees is $2.63 per hour. Massachusetts employers must inform their employees of the tipped minimum wage law.
If an employee's tips plus their direct hourly wage does not equal the minimum wage, the employer must make up the difference. Employees have the right to retain their tips or contribute them to to a valid tip-pool, which must comply with Massachusetts wage and hour law.
