Are Missouri workers entitled to meal breaks or rest periods?
Missouri wage and hour law does not require that employers offer lunch periods or rest breaks. Union contracts or company policies may address this issue.
Are workers entitled to vacation days, sick leave or health insurance?
Missouri wage and hour law does not require that employers offer paid vacation to public sector employees. Additionally, Missouri employers are not required to offer health insurance or sick days.
If an employee is fired, when should they receive their final paycheck?
Fired employees should receive their final wages at the time of termination. If not, the fired employee should send a letter by certified mail return receipt requested asking for their final paycheck. The employer has seven days to furnish the wages. If the employer does not respond within this time period, the employee can pursue a private lawsuit. Employees attempting to recover a paycheck of less than $3000 can file their claim in small claims court; those seeking more than $3000 should seek the help of a private Missouri wage and hour lawyer.
If a worker voluntarily leaves their job, when should they receive their final paycheck?
Missouri wage and hour law does not have a rule regarding final wages for employees who quit. If the worker does not receive all wages due by the next regularly scheduled payday, they must take legal action to recover their final paycheck.
Do employers have to provide a statement of deductions to their employees?
Once a month, employers must provide their workers with a statement of deductions. If this statement is not provided, legal action can be taken.
Can employees be forced to work more than 8 hours a day or 40 hours a week?
Missouri wage and hour law does not restrict the amount of hours an employee can work. If an employee refuses to work overtime, they can be terminated.
Can a Missouri employer change a worker’s pay rate?
Yes. However, they cannot reduce a worker’s pay rate to beneath the minimum wage. Missouri wage and hour law requires employers to provide a 30-day written notice when reducing a worker’s wages.
Are employees required to provide two weeks notice when they leave their job?
At-will Missouri employees do not have to provide notice when they quit their job.
What is the Missouri minimum wage?
The minimum wage in Missouri is $7.25 per hour, which is the same as the federal rate.
What is the overtime law in Missouri?
Certain Missouri employers must pay employees 1.5 times their regular rate for hours worked in excess of 40 during a single workweek. Missouri workers are not entitled to overtime when working more than 8 hours in a day.
