If an employee quits or is fired, when should they receive their last paycheck?

Workers should receive their final wages by the next regularly scheduled payday or within two weeks of termination, whichever comes first. This law applies to both fired employees and those who voluntarily leave their jobs.

What is the Nebraska minimum wage?

Effective July 24, 2009, the minimum wage in Nebraska is $7.25 per hour. Companies employing four or more workers must comply with Nebraska minimum wage law.

Are Nebraska workers entitled to rest breaks?

Neither federal nor Nebraska wage and hour law requires employers to provide short breaks or rest periods to their workers.

Can an employer make deductions from a worker’s paycheck?

Employers can deduct cash shortages, breakage, tools etc. from an employee’s paycheck as long as they have written authorization from the employee. These deductions cannot result in an employee earning less than the Nebraska minimum wage.

Are Nebraska workers entitled to meal periods?

Those working in mechanical establishments, assembling plants or workshops are entitled to a 30-minute meal period. In all other industries, meal breaks are provided at the discretion of the employer.

Can a worker be required to work overtime?

Yes. Nebraska employers can require employees to work overtime.

Are Nebraska workers entitled to fringe benefits?

Vacation days, sick leave, holiday pay and pay raises are not required by Nebraska wage and hour law. These fringe benefits are provided at the discretion of the employer. Upon termination, employees should receive compensation for vacation days in their final wages. Unless a contract, policy or written agreement states differently, no other fringe benefits are payable upon termination.
