Overtime Law in New Hampshire
Workers covered by RSA 279 should receive time-and-a-half compensation for hours worked over 40 in a single workweek.
The following employees are exempt from overtime under New Hampshire overtime law:
- Workers in an amusement, seasonal or recreational establishment as long as it does not open for more than 7 months per calendar year OR during the last calendar year, its average receipts for any six months were no more than 33.3% of its average receipts for the other six months.
- Workers covered by the federal overtime law known as the Federal Fair Labor Standards Act (FLSA).
