What is the minimum wage in New Hampshire?

Effective Sept. 1, 2008, the New Hampshire minimum wage is $7.25 per hour.

When is overtime due?

Unless exempt under the Fair Labor Standards Act (FLSA), employees should receive time-and-a-half compensation for hours worked in excess of 40 in any one week.

Are New Hampshire workers entitled to lunch breaks?

Under New Hampshire wage and hour law, employees working five or more consecutive hours must receive a 30-minute meal period. If an employee must work through their lunch break while eating, they must be compensated.

If an employee quits or is fired, when should they receive their final paycheck?

If an employee quits, they must receive their final wages by the next regularly scheduled payday. If a worker is terminated, they must receive their last paycheck within 72 hours.

Are employers required to provide pay stubs to their employees?

New Hampshire employers must furnish pay stubs to each employee detailing deductions (i.e. taxes, insurance costs, loans etc.) for that pay period.

Can employers make deductions or withhold wages?

Employers are only allowed to make deductions in two instances. Employers can make deductions that are required by law, such as taxes. They can also make deductions which benefit the employee, who must first give written authorization to make such a deduction.

Are newly hired employees entitled to any written notices prior to working?

Yes. Newly hired workers should receive a written notice of their rate of pay, as well as a detailed description of all policies regarding fringe benefits.

Are employees required to pay for their own uniforms?

No. Uniforms containing a logo or that have a distinctive design must be provided to workers at the expense of the employer. If not returned, the company can deduct the cost of the uniform from the employee’s final paycheck.

Are employers required to keep time records for their workers?

Employers must keep accurate records of hours worked and wages paid for every employee. These records must be kept for at least four years.
