Rest Periods, Meal Breaks, Final Wages

Back to North Dakota Overtime Law

An unpaid, uninterrupted 30-minute meal break should be given to employees who work more than five consecutive hours, as long as there are at least two workers on the shift. Employers can, but are not required to, offer short coffee or rest breaks. If the break lasts less than 30 minutes, the time is compensable.

Employees who quit, are laid off or fired must be paid on the next regularly scheduled payday, as if the employee-employer separation never occurred.
