Are Oklahoma workers entitled to meal periods or rest breaks?

Oklahoma employers are not required to provide breaks to workers ages 16 or older. Breaks and meal periods are provided at the discretion of the employer.

What is the minimum wage in Oklahoma?

Effective July 24, 2009, the Oklahoma minimum wage is $7.25. This is the same as the federal rate.

Who must comply with Oklahoma minimum wage law?

Unless otherwise covered by federal wage and hour laws, employers must follow Oklahoma minimum wage laws as long as the company retains at least 10-full time workers and makes more than $100,000 per year.

How often should employees be paid?

Employees must be paid at least twice per calendar month. Exempt, state, county and municipal workers must be paid at least once per calendar month.

Are Oklahoma workers entitled to benefits?

Oklahoma employers are not required to provide fringe benefits. However, if the company has a written policy for providing benefits, the employer may or may not be eligible for benefits. Employees should review their employee handbooks for their specific policies.

Are employees entitled to overtime pay?

If a company is subject to federal wage and hour law, non-exempt employees should receive 1.5 times their regular rate for hours worked in excess of 40 during a single workweek.

Can workers be required to work more than their scheduled hours?

Employers have the authority to schedule the minimum and maximum number of hours employees can work. The company can change employees’ hours without notice and require employees to work overtime.

When should final wages be paid?

If an employee quits or is fired, they should be paid by the next regularly scheduled payday.
