Technical Writers: Unpaid Overtime Claims
Technical writers who were denied overtime pay may be eligible to participate in an unpaid overtime lawsuit to recover back pay.
Technical writers are entitled to overtime pay unless they meet the specific requirements of an exempt employee. When a non-exempt technical writer is denied overtime pay due to employee misclassification or another illegal wage and hour practice, they may be eligible to file an unpaid overtime lawsuit on behalf of themselves and similarly situated employees. Depending on the details of their unpaid overtime case, the plaintiff may be able to collect up to three years of unpaid overtime, as well as an equal amount in liquidated damages. For example, if a technical writer files an overtime lawsuit and recovers $4000 in back pay, he or she may also be entitled to another $4000 in liquidated damages.

Unpaid Overtime Lawsuits: Technical Writers
In July 2010, a California court approved a $5 million settlement to more than 150 technical writers who collectively filed a claim against their employer, Sun Microsystems. According to the unpaid overtime lawsuit, Sun Microsystems allegedly misclassified its technical writers as exempt from overtime pay under state law. A common overtime scam, employee misclassification occurs when an employer intentionally classifies their non-exempt workers as exempt from overtime wages. Technical writers who suspect they have been misclassified should contact an overtime attorney to learn more about their legal rights.
