If an employee quits or is fired, when should they receive their last paycheck?

Workers who are fired, laid off or who quit must receive their final paycheck on the next regularly scheduled payday, not to exceed 21 days from the date of separation from the company.

Are Tennessee employees entitled to meal periods and rest breaks?

Employees who work for six consecutive hours must receive a 30-minute break, except when the nature of the job allows for the employees to take frequent breaks.

How often should employees be paid?

Private employees must be paid at least semi-monthly. Notice of regular paydays must be posted in two conspicuous places in the workplace.

Can an employer reduce a worker’s pay rate?

Yes. However, Tennessee employers are required to inform the employee of the change before any work at the new rate is performed. An employee cannot work without knowing the rate at which they are to be paid.

Can an employer withhold a worker’s paycheck until they return their uniform, keys, etc?

No. An employer cannot withhold paychecks for any reason.

Can an employer make deductions for uniforms, loans, cash shortages, equipment, etc. from an employee’s wages?

An employee cannot make this deduction without the worker’s consent.

Are Tennessee employees entitled to sick days, health insurance, vacation days, holidays or severance?

No. Tennessee wage and hour law does not require employers to offer fringe benefits. Company policy regulates fringe benefits.

If an employee quits or is fired, should they be paid for any unused vacation time?

No, unless the company’s policy or an employee agreement requires that unused vacation days become payable upon termination.

How many hours must be worked to be considered a full-time employee?

The employer, not Tennessee wage and hour law, sets the definition for full-time and part-time employees.

Can an employer pay their workers through direct deposit?

Yes. However, the employee has the right to choose their bank.
