Texas employers are allowed to establish pay days for their employees. However, they are required to follow certain Texas wage and hour laws regarding pay days. For instance, Texas employers must pay workers who are exempt from the Fair Labor Standards Act (FLSA) at least once per month. Employees who are covered by the FLSA must be paid at least twice per month.
Texas employers must post a notice listing the regularly scheduled pay days for employees in an easily viewable place in the workplace. If an employer does not establish paydays for its employees, wages should be given on the 1st and 15th of every month.
Employees who quit must be paid by the next regularly scheduled payday. Employees who are fired must receive their final paychecks within six days. If a worker is absent (or for any other reason is not paid) on a scheduled pay day, they must receive their paycheck on another business day as requested by the worker.
