Virginia Minimum Wage, Labor Law Questions

Back to Virginia Overtime Law

When should employees be paid?

Employers must determine regular paydays and pay rates for their workers. Employers who do not pay all wages due on the scheduled paydays are in violation of Virginia wage and hour law. Hourly workers must be paid at least twice per month or once every two weeks. Salaried employees must be paid at least once per month.

When an employee quits or is fired, when should they receive their final paycheck?

Employees who quit or are fired must receive their final wages by the next regularly scheduled payday.

Can an employer reduce a worker’s pay rate?

Yes, as long as the reduction does not bring the worker’s wage beneath the minimum wage. In addition, the employer must inform the worker of the reduction before work is performed at this new rate. The worker has the right to accept the lower wage or quit.

What is the Virginia minimum wage?

The Virginia minimum wage is $7.25 per hour.

Are workers entitled to meal periods or rest breaks?

Under Vermont wage and hour law, only workers ages 16 and younger are entitled to meal or rest breaks.
